Falcon Rappaport & Berkman’s launch of the firm’s AI Business Litigation Subscription Model was featured in Law360.

The article highlights FRB’s new subscription-based model for business litigation matters, which pairs AI-native workflows with predictable monthly pricing. The service was launched out of the firm’s Newark, New Jersey office, and is designed to give clients a more transparent, efficient, and practical alternative to the traditional billable hour. At the center of the rollout is a powerful legal AI tool, Harvey. This tool allows FRB’s clients to collaborate in real time on strategy and workflow, all while preserving the attorney-client privilege.  

For many small and mid-sized businesses, the cost uncertainty of litigation can make even legitimate claims difficult to pursue. FRB’s new model addresses that challenge by replacing open-ended hourly billing with a monthly subscription structure for recurring litigation work, along with flat fees for certain contested events such as dispositive motions, depositions, and trials. 

Moish E. Peltz, Co-Chair of FRB’s Artificial Intelligence Practice Group, explains that the “firm made the right call to do the hard work to restructure an economic model around an agentic workflow” and the launch reflects both a shift in client expectations and the growing impact of AI on the delivery of legal services.  

As discussed in the Law360 article, the service initially focuses on business litigation and corporate representation in New Jersey and New York, including business disputes, shareholder and partnership conflicts, breach of contract claims, breach of fiduciary duty matters, and related corporate representation.  

Further, Christopher D. Warren, Co-Chair of the Artificial Intelligence Practice Group, emphasized that AI can help compress the time required for work traditionally completed entirely by attorneys, while allowing firms to create pricing models that better align value, efficiency, and client expectations. "The client knows the cost, the firm captures the value of its own efficiency in an ethical manner, and the matters the hourly model was pricing out come back into reach," Warren said. 

FRB has described this shift as the “death of the point-one,” referring to the tenth-of-an-hour billing increment that has long defined traditional legal invoices. As AI changes the speed and structure of legal work, FRB’s subscription model is intended to move beyond time-based billing and toward a system focused on predictability, access, and value. 

The launch follows FRB’s recent opening of the Newark office, which is focused on the development and testing of new AI tools. In addition to the business litigation subscription service, the firm is also developing a separate AI subscription model focused on real estate, with potential expansion into transactional and advisory services.
