Falcon Rappaport & Berkman Secures Summary Judgment Win for Go Global on Key Breach of Contract Claim in Trade Secrets Dispute
Falcon Rappaport & Berkman is proud to announce that our Intellectual Property and Litigation Practice Groups secured a summary judgment victory for our client, Go Global Retail, on a key breach of contract claim.
Go Global, a brand investment firm known for revitalizing retail brands, initiated the action as part of a dispute involving a potential partner’s theft of its confidential information and trade secrets while Go Global was preparing to mount a bid of a target company in a bankruptcy auction.
Go Global turned to FRB to enforce contractual rights and to protect the trade secrets it had worked hard to develop and sought to protect under a Non-Disclosure Agreement (which had been prepared by FRB). Our litigation team filed claims for breach of contract and trade secret misappropriation under both New York State and federal law (including the Defend Trade Secrets Act).
On September 26, 2025, Judge Subramanian, District Judge from the Southern District of New York, granted summary judgment for Go Global on its claim for breach of contract, finding that the defendant violated the NDA by disclosing and misusing Go Global’s confidential information. The Court further ruled that Go Global’s trade secret claims and damages will now proceed to trial.
This decision reinforces the importance of clear contractual protections when sharing sensitive business information, especially in high-stakes transactions. NDAs are more than mere paperwork. They are enforceable agreements that safeguard competitive advantages and intellectual property.
