Alternative Dispute Resolution
Clients today want creative, practical approaches to resolving conflicts in less time and with less cost than in standard courtroom litigation. Falcon Rappaport & Berkman’s Alternative Dispute Resolution (ADR) Practice Group has a team of accomplished litigators whose firsthand knowledge of trial strategy and case management makes them uniquely effective advocates in arbitration and mediation proceedings spanning diverse industries and subject matters.
Our litigators bring years of hands-on experience representing clients in arbitration and mediation forums of every kind, from proceedings administered by the American Arbitration Association (AAA), cross-border disputes with AAA-ICDR, JAMS, and the Financial Industry Regulatory Authority (FINRA), as well as private and court-annexed programs in state and federal jurisdictions. We work closely with clients to assess the most advantageous forum for each dispute, build a tailored strategy, and advocate vigorously from the first filing through final resolution.
Our ADR Practice Group also benefits from firsthand experience on the other side of the table. A member of the group has served for more than a decade as an arbitrator and mediator, presiding over commercial, employment, consumer, and general business disputes, as well as claims under the Americans with Disabilities Act (ADA) and the Electronic Funds Transfer Act (EFTA), and holds appointments to respected arbitral panels and court-designated neutral rosters. That experience informs how the group prepares and presents every matter, giving our advocates a distinctive understanding of how disputes are evaluated and resolved. As our practice continues to grow, we anticipate that additional experienced litigators in the group may also serve as neutrals.
Whether a client’s priority is privacy, preserving a key business relationship, or reaching resolution quickly, our ADR attorneys provide focused, strategic representation at every stage. We also work with attorneys across the firm to build well-crafted ADR provisions into new agreements, so clients are better positioned if a disagreement later arises.
