Death of the Billable Hour  

For over a hundred years, the billable hour has decided which cases get pursued and which get abandoned. The math is unforgiving, and meritorious claims have walked away from the courthouse because the cost of litigation no longer matched the value of the dispute. 

Value based pricing changes that calculus. A monthly subscription covers the recurring work of an active case. Discrete contested events are priced as predictable flat fees when, and if, they arise. Clients know what their litigation will cost before it starts, not after. 

Who This Is For  

FRB recognizes that litigation needs to be tailored for businesses that want their legal counsel to align with their outcome, not a clock. The model is particularly well suited to small and mid-sized businesses whose litigation budgets have historically been outmatched by hourly billing. 

This value-based arrangement is offered for plaintiff and defense engagements in business litigation for new FRB clients. Existing FRB clients should contact their attorney to discuss converting their matter to an alternative fee arrangement. FRB clients who prefer traditional hourly engagements may continue on that basis. 

What’s Included in the Monthly Subscription 

Your monthly fee covers the ongoing work that keeps an active matter moving forward.  

  • Pleadings Complaints or answers with affirmative defenses, counterclaims, cross-claims, third-party complaints, and replies.
  • Affirmative Discovery Drafting and serving interrogatories, requests for production, and requests for admission. Non-party subpoenas. Rule 26 disclosures and supplements. ESI protocol negotiation and any meet-and-confers.
  • Pre-Suit Work Investigation, demand letters, preservation notices, insurance tender and coverage analysis, and pre-suit settlement correspondence.
  • Court and Case Coordination Status, scheduling, case management and discovery conferences. Routine correspondence with opposing counsel, including letters and notices. Calendar, deadline, and file management.
  • Client Collaboration Consistent reporting, ongoing strategy, and full access to an AI workspace where you can review your matter, ask questions, and participate actively in your case.

Contested events and discrete events are priced as predictable flat fees for when, and if, they ever arise. Clients will know what their litigation will cost before it starts, so there are no surprises when litigation intensifies.

What’s included in the monthly subscription?

What is priced as a flat fee instead?

Contested motion practice, discovery responses, depositions, trial preparation and trial days, mediation and arbitration, settlement drafting, appellate work, and emergency applications such as TROs and preliminary injunctions. Each is scoped and quoted before work begins.

How much does the subscription cost?

Subscription rates are negotiated at engagement based on the scope, complexity, and posture of the matter. Pricing is set before work begins and adjusts only on defined Triggering Events such as the addition of parties or claims, removal, transfer, or a material change in case posture. What is the workspace?

How is the workspace different from using a consumer AI chatbot?

Public chatbots are not designed for privileged communications. The workspace lives inside FRB’s secure environment, so attorney-client privilege is preserved and your matter’s information is not used to train public models.

Does the subscription model reduce the quality of representation?

No. The model changes how clients are billed, not the standard of representation. AI handles the work it is well suited for, attorneys handle judgment, strategy, and advocacy, and every output is reviewed under attorney supervision.
