With employees using generative AI on almost a daily basis, it’s difficult for the courts to keep up with all the various rights and issues that go along with the use of generative AI.

One issue that is currently evolving is who owns the work product that an employee puts in and gets out of a generative AI enterprise system that the company pays for.

Is it automatically owned by the company? It’s not so clear. A good safeguard for employers to have is a special policy that clearly states that the work product related to an employee’s use of an AI platform that is paid for by the company is owned by the company.

So all work that an employee does on an employer enterprise system is work product that is owned by the company and not the employee.

As this area of the law develops, it’s important for employers to keep up to date with all of these AI developments.
